Medical marijuana (cannabis) is legal in my state. Can I get it reimbursed?
In short, the answer is no.
Some states allow the use of marijuana for medical purposes, but it is still considered an illegal drug at the federal level. Since federal laws govern your HRA, marijuana cannot be reimbursed under your HRA.
Fees or visits associated with obtaining a medical marijuana card are also not eligible for reimbursement.
What about CBD products?
CBD products used for medical purposes are only eligible with a letter of medical necessity (LOMN) and cannot contain more than 0.1% THC.
